      Confidentiality and HIPAA (Health Information Portability and Accountability Act) Policy for Allison Velez, Emotion Mastery, LLC, and Winning Your Relationship Game
 
          HIPAA is a governmental rule protecting Personal Health Information (PHI).  PHI is an individual’s identifiable information related to past or current physical or mental health conditions of a person receiving services from one of the entities above. 

            Upon entering services, a record is created.  This record consists of the following information:  personal demographic, billing, records received from other providers, record of information shared with other providers, notes regarding assessment and ongoing sessions, claims adjudication, and any documents shared by you.

            Your PHI is not shared without your express consent (except as allowed by law) and on a need to know basis by employees or contractors of the above entity.  All employees and contractors sign a contract for confidentiality upon partnering with the above. 

            Restrictions on disclosures are not applicable on information related to a crime. Restrictions do not apply to the reporting of suspected child abuse and neglect.  Restrictions do not apply to a medical emergency involving the individual’s PHI.  This may include an emergency of a physical or emotional nature.  Restrictions do not apply when I am defending myself against a legal action taken by you. Restrictions do not apply to activities related to In all the above cases, information will be shared on as “as needed” basis. 

            Paper records are secured as per legal requirements.  Some records are stored electronically.  PHI is not shared or stored electronically unless it is encrypted for additional security.  All electronic storage entities have signed a Business Associate’s Agreement which states they maintain a HIPAA compliant environment.  As stated, I do not store PHI unless it has an additional encryption. 

            Physical and electronic records may be destroyed or deleted in accordance with state and federal laws.

            If you wish to review or receive a copy of your record, if the information is strictly related to you (i.e. if couple’s counseling, two people’s information is involved).  There are situations where information may create an unsafe situation for you.  In this case, I may select to review the information with you.  In most cases, notes may be in shorthand and it is preferable to receive a summary of treatment.

            In addition, copying or downloading and printing multiple notes may be cost and time prohibited.  I will provide 10 pages of records at no cost to you.  Pages above and beyond 10 will be provided at the cost of $1 per page.
